These Terms and Conditions constitute a binding legal agreement between you and Lumex Tide Grid when you use our website or book one of our experiences. Please read them carefully. Last updated: 18 April 2025.

1. The agreement

1.1

By accessing this website or booking an experience with Lumex Tide Grid, you confirm that you have read and agree to be bound by these Terms and Conditions.

1.2

These terms apply to all visitors to the website and to all participants in our guided experiences. If you are booking on behalf of others, you accept these terms on their behalf as well.

1.3

Participation in our experiences is open to individuals of all ages. Guests under 16 years of age must be accompanied by a responsible adult throughout the duration of the experience.

2. User obligations

2.1

You agree to behave respectfully toward our guides, other participants, and the natural environments we visit. Our experiences take place in public parks and gardens that are shared spaces deserving of care.

2.2

You agree to follow the reasonable instructions of your guide at all times, including directions regarding access, noise levels, and conduct within park areas.

2.3

You are responsible for ensuring you have appropriate travel insurance and any documentation required to participate in activities in Japan. Lumex Tide Grid is not responsible for any costs arising from inadequate preparation.

2.4

You agree to comply with all applicable laws and park regulations during the experience, including rules regarding waste, noise, and access to protected areas.

3. Prohibited activities

The following are not permitted during Lumex Tide Grid experiences:

Damaging, climbing on, or removing any part of the trees or park vegetation
Commercial photography or filming during the experience without prior written consent from Lumex Tide Grid
Disruptive or aggressive behaviour toward any member of the group or other park visitors
Bringing or consuming alcohol or other substances not expressly included in the experience

Lumex Tide Grid reserves the right to end an experience early and ask a participant to leave if any of the above occur, without refund.

4. Liability and warranties

4.1

Lumex Tide Grid takes all reasonable care to ensure the safety and quality of its experiences. However, participation in outdoor activities involves inherent risks, and Lumex Tide Grid cannot accept liability for personal injury, loss, or damage arising from participation where reasonable precautions have been taken.

4.2

The information on this website is provided in good faith. Lumex Tide Grid makes no warranties regarding the accuracy or completeness of the content and accepts no liability for errors or omissions.

4.3

To the fullest extent permitted by law, Lumex Tide Grid's liability for any claim arising out of these terms or use of the website is limited to the amount paid, if any, for the relevant experience.

4.4

Lumex Tide Grid is not liable for consequential, indirect, or incidental losses including lost profits, travel costs, or accommodation costs arising from any change or cancellation to an experience.

5. Indemnification

You agree to indemnify and hold Lumex Tide Grid harmless from any claims, damages, or expenses (including reasonable legal costs) arising from your breach of these terms, your conduct during an experience, or any misrepresentation you have made in connection with a booking.

6. Legal information and disputes

6.1

These Terms and Conditions are governed by the laws of Japan. Any disputes shall be subject to the exclusive jurisdiction of the courts of Tokyo.

6.2

Before initiating formal proceedings, both parties agree to attempt to resolve any dispute in good faith through direct communication. Please contact us in the first instance.

6.3

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions continue in full force. These terms represent the entire agreement between you and Lumex Tide Grid with respect to their subject matter.

7. Force majeure and modifications

Lumex Tide Grid is not in breach of these terms and accepts no liability where performance is prevented or delayed by circumstances beyond its reasonable control, including but not limited to: adverse weather, acts of government, public health measures, natural events, or park closures.

We may update these Terms and Conditions from time to time. The revised version will be posted on this page with a new effective date. Your continued use of the website or services after any change constitutes acceptance.
